I'm really surprised this guy didn't knock him the f.. knock him out.
Makes me wonder if I would be able to put my (admittedly pretty skant) aikido training to good use and relieve the officer of his baton in a similar situation. I wonder what he'd do if the guy just grabbed the baton from him and tossed it away.
The motorist had a right to defend himself in a situation like that, why didn't he do it? I would have taken the baton and and cracked the officers head open with it.
Actually, I think he would...I've fought with police officers before and they are just like anyone else when it comes to getting hit.
The only sensible option while being so severely attacked is to stop it from continuing, let the courts decide afterwards what will be done. I'd prefer to be alive rather than dead or suffering serious brain damage, just because some fucking pig needs a baton to make up for his little prick.
Strength has nothing to do with anything I just said. A simple reversal would remove his baton and a baton strike to the temple would knock anyone out cold. The whole thing wouldn't take more than two seconds.
And I'm quite confident that my logic would not be compromised by one semi-armed police officer. If that situation, I wouldn't see them any different than someone trying to mug me with a baton. A police officer with a baton is not that much of a threat.

Anyone else think the only reasonable thing to do here is to hand this man a baton and let him beat the crap out of the policeman? I mean, that would be justice. :?
I like your wording, out of the many many students I've had over the years, quite a few were cops who were smart enough to realize that their police training was a joke and that it had to be supplemented by a real teacher. :)
I am able to tell by how the officer held and used the baton, that he didn't know how to use it properly and someone with only minimal training could have easily disarmed him.
If a cop is willing to beat the shit out of you with a baton for nothing, he'd probably pull his gun on you if you successfully took it from him.
It takes about 2 seconds for him to pull a gun and discharge it with good reaction time, it takes a fraction of that time to knock someone out with a baton if you know how to use it. He'd be unconscious before he got his hand anywhere near the gun. The law would protect the victim and the cop would be responsible for any damage that you inflicted with the baton.
Self defense law protects the person doing the defending. The officer is still a mortal threat because the victim knows that he's got a lethal weapon, so even with a baton, the victim is the defender.
That would make a good defense in theory, but in reality, they'd probably turn it around on you as "resisting arrest". Even though it would be more correctly described as "resisting getting the fuck beaten out of you". The law kind of expects you to lie down and take it in the ass from those who enforce it.
...Actually, it kind of reminds me of Disney's Robin Hood, the part where Prince John tries to smack Sir Hiss, who moves out of the way. John, genuinely shocked, says "Hiss! You deliberately dodged!"
Not with 2 witnesses and a video. The cop will try it, but any lawyer worth half of what he's paid can easily shoot that down.
