It is possible that the charges go through due to the fact that he might not have had reasonable expectation for privacy depending on whether or not his yard was fenced in and whether or not it was visible from public ground like a sidewalk. Nonetheless, they were trespassing on his property. An interesting detail is that the woman's husband is a police officer.
